Article 1 (Application)
These Terms of Service (“Terms”) set forth the conditions for using the online store and related services (“Service”) operated by DISTURN (“Company,” “we,” “us,” or “our”).
By using the Service, users agree to these Terms. Any separate guidelines, policies, or rules established by the Company regarding the Service (“Supplementary Terms”) shall constitute part of these Terms.
In the event of any inconsistency between these Terms and Supplementary Terms, the Supplementary Terms shall prevail.
Article 2 (Eligibility)
Users must have the legal capacity to enter into contracts under applicable laws.
If a minor uses the Service, consent from a parent or legal guardian shall be deemed to have been obtained.
Users agree to provide accurate, complete, and current information, including but not limited to name, address, telephone number, email address, payment information, and any other requested information, and to keep such information updated.
Users are responsible for maintaining the confidentiality and security of account credentials and passwords and may not transfer, lend, share, or sell them to any third party.
Article 3 (Products)
We make every effort to display product information, images, and colors as accurately as possible. However, actual appearances may differ depending on device settings, display environments, and viewing conditions.
Product specifications, pricing, and availability may be changed without prior notice.
We reserve the right to limit product quantities, sales territories, and sales periods at our discretion.
Article 4 (Orders and Formation of Contract)
Any order submitted by a user constitutes an offer to purchase.
A sales contract shall be deemed concluded when we issue an order confirmation notice or shipping confirmation notice.
We reserve the right to reject or cancel orders in the following cases:

Article 5 (Pricing and Payment)
Prices displayed at the time of purchase shall apply.
Unless otherwise stated, prices do not include applicable taxes, shipping charges, customs duties, import taxes, VAT, or customs processing fees.
Customers are responsible for customs duties, VAT, import taxes, and any other charges arising from international shipping.
Article 6 (Shipping)
Estimated shipping and delivery dates are estimates only and are not guaranteed.
We are not responsible for shipping delays caused by weather conditions, carriers, customs procedures, natural disasters, or other circumstances beyond our reasonable control.
Risk of loss and title for purchased products transfer to the customer upon delivery of the goods to the shipping carrier.
Article 7 (Intellectual Property Rights)
All content available through the Service, including text, images, logos, designs, trademarks, and product information, is owned by the Company or applicable rights holders.

Users utilizing AI agents, scraping tools, bots, automated software, or similar technologies to access the Service must comply with any access conditions designated by the Company.
We reserve the right to limit, suspend, or prohibit automated access at our sole discretion.

Except in cases involving our intentional misconduct or gross negligence, we shall not be liable for damages arising from use of the Service.
Nothing in these Terms excludes liability where such exclusion is prohibited under applicable consumer protection laws.
Article 12 (Limitation of Liability)
To the maximum extent permitted by law, our total liability shall not exceed the amount paid by the user for the applicable product or service, except in cases involving our willful misconduct or gross negligence.
Article 13 (Personal Information)
Personal information collected through the Service shall be handled in accordance with our Privacy Policy.
The Service operates using Shopify infrastructure, and certain user information may be shared with Shopify and related service providers for operational purposes.
Article 14 (Changes to Terms)
We reserve the right to modify these Terms where required by law, operational necessity, or other reasonable circumstances.
Updated Terms shall become effective upon posting on this website or on the specified effective date.
Article 15 (Governing Law and Jurisdiction)
These Terms shall be governed by and interpreted in accordance with the laws of Japan.
Any disputes arising from or related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance.
Article 16 (International Sales and Overseas Use)

Users are responsible for ensuring compliance with local laws, import regulations, taxes, duties, customs procedures, and other legal requirements applicable in their jurisdictions.
Customs duties, VAT, import taxes, customs fees, and similar charges arising from international shipments shall be borne by the customer unless otherwise stated.
If delivery becomes impossible due to local regulations, customs restrictions, or refusal of acceptance by the customer, we may deduct shipping, return shipping, customs expenses, and related costs from any refund amount, or decline refunds where appropriate.
We reserve the right to restrict or discontinue sales or shipping to specific countries or regions.
Article 17 (Special Provisions for Asia Region)
Shipments to countries and regions within Asia may be subject to delays, restrictions, or delivery limitations due to import regulations, inspection requirements, customs procedures, or governmental actions.
We shall not be liable for delays, confiscation, customs holds, or similar events arising from circumstances beyond our reasonable control.
Article 18 (Special Provisions for European Region)
For customers residing in the European Union (EU) or European Economic Area (EEA), mandatory consumer rights provided under applicable laws shall remain unaffected by these Terms.
We shall process personal information in compliance with the General Data Protection Regulation (GDPR) and other applicable laws.
Requests relating to personal data, including access, correction, deletion, and similar rights, shall be handled in accordance with our Privacy Policy.
